Mercatus Academy

Terms & Conditions

Last updated: 16 October 2026

These terms apply when you purchase or receive tuition or another service from Mercatus Academy. Please read them together with our Cancellation & Refund Policy and Educational & Trading Risk Disclaimer.

1. About Mercatus Academy

Mercatus Academy provides foreign exchange education and one-to-one tuition in the United Kingdom and South Africa. Company No: 17157818 England & Wales. You can contact us at mercatusacademy@outlook.com, by WhatsApp on +44 7712229994 or by telephone in South Africa on +27 609366925.

2. Our educational services

Course descriptions, prices and intended learning levels are shown on the website. Tuition is mainly delivered online. Face-to-face tuition may be available depending on location and must be agreed in advance. One-to-one online tuition normally involves the educator sharing a trading screen and explaining the learning material step by step.

We may make reasonable changes to lesson order, examples or supporting material where this improves the learning experience without materially reducing the service purchased.

3. Booking and formation of the contract

Website content is an invitation to enquire or place an order. A contract is formed when payment has been accepted and Mercatus Academy confirms the selected course or service. We will then contact you to arrange a mutually suitable start date, subject to educator availability.

Please check that your name, email address and other contact information are correct. You are responsible for telling us promptly if they change.

4. Prices and payment

Prices are displayed in the currency and for the market stated on the relevant Pricing & Pay page. Payments are processed through Revolut or another payment method expressly agreed with Mercatus Academy. We do not receive or store your complete payment-card details.

Access to tuition or another paid service may be withheld until the applicable payment has been received.

5. Scheduling, attendance and technology

Session dates and times are arranged by mutual agreement. If you need to rearrange a session, please give as much notice as reasonably possible. Repeated missed sessions or late cancellations will be discussed with you fairly and may affect future scheduling.

For online tuition, you are responsible for a suitable device, stable internet connection and any software or trading platform required for the lesson. A laptop or desktop computer is recommended. Each party is responsible for technical issues within their own control. Where a significant issue prevents tuition, we will make reasonable efforts to rearrange the affected session.

6. Cancellations and refunds

Our Cancellation & Refund Policy forms part of these terms. Course payments are fully refundable where no tuition has started. If you expressly ask us to begin tuition and later cancel after sessions have started, completed tuition may be charged proportionately and the unused balance calculated for refund.

Where UK distance-contract cancellation rights apply, you will normally have 14 days from the day after the contract is made to cancel. If you ask us to begin within that period, you may be required to pay for services supplied up to cancellation. Nothing in these terms limits your statutory rights.

7. Educational purpose and student responsibility

All tuition and website content are provided for education only. They are not personalised investment advice, a recommendation to enter a trade, portfolio management or a guarantee of any outcome. You remain responsible for your own decisions, accounts, trades and risk. Please read our Educational & Trading Risk Disclaimer.

8. Funded accounts

Challenge and instant funded-account products are separate from tuition and are planned to start in 2027. Availability, eligibility, prices, evaluation phases, profit objectives, risk limits, prohibited conduct, withdrawals and account closure will be governed by separate programme terms supplied before purchase. Paying a fee does not guarantee that an account will be funded or that any profit will be earned.

9. Learning materials and recordings

Course notes, presentations, videos, screen displays, graphics and other learning materials remain the intellectual property of Mercatus Academy or their respective owners. They are supplied for your personal learning only and must not be copied, sold, published, shared or used to train others without written permission.

You must not record a tuition session, or permit another person to attend, without the educator’s prior agreement. Mercatus Academy will not record you without appropriate notice and permission.

10. Respectful participation

Students and educators must communicate respectfully. We may pause or end a session where there is abusive, threatening, unlawful or seriously disruptive behaviour. Where a service is ended for serious misconduct, any refund will be assessed fairly in light of tuition already supplied and applicable consumer rights.

11. Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

Subject to those protections, Mercatus Academy is not responsible for trading losses, missed market opportunities, third-party platform failures or decisions made using educational material. We will provide the purchased educational service with reasonable care and skill.

12. Events outside reasonable control

We are not responsible for delay caused by events outside our reasonable control. We will contact you when reasonably possible and take practical steps to reduce disruption, including rearranging affected tuition where appropriate.

13. Privacy

We process personal information as explained in our Privacy Policy. Third-party providers such as Formspree and Revolut process information under their own terms and privacy notices.

14. Complaints

Please send any complaint to mercatusacademy@outlook.com with your name, course and a clear description of the issue. We will acknowledge and consider the complaint fairly and aim to provide a clear response within a reasonable time.

15. Governing law

These terms are governed by the law of England and Wales. If you are a consumer living elsewhere, including South Africa, you retain any mandatory protections available under the law that applies to you. Courts with jurisdiction under applicable consumer law may hear disputes.

16. Changes to these terms

The terms applying to your purchase are those provided or available when the contract is made. We may update these website terms for future purchases. Material changes will not be applied retrospectively where doing so would unfairly reduce existing rights.
